CHAPTER SIX
On the second day of the first trial, Michelle “Mimi” Enzler returned to the witness stand.
She told the court that her relationship with Billy Smith had continued for several years and though they never lived together, the were intimate.
She said on Aug. 30, 1997, she received a phone call from Smith asking her to come to Alaska to talk about Harold and Nancy. She said she remembered the date because that was the day Britain’s Princess Diana died.
“Eventually he did tell me he had confessed to their murders, but [said] he was protecting somebody else,” she said. “He admitted his involvement.
“I was devastated,” said Mimi Enzler.
When asked by prosecutor Wolfe whether Smith gave her any reasons for killing the couple, Enzler said, “He did tell me the men in black suits were going to take Francis away and he was going to protect us.”
“Did you associate the men in black suits with the witness protection program?” Wolfe asked.
“Yes, actually,” she said.
“Did you receive any letters from Billy Smith at that time?” Wolfe wanted to know.
“Yes, I received several,” she replied. “We communicated back and forth. He wrote more.”
Wolfe then produced one of the letters and asked Enzler to verify that it was one of the letters from Smith the Alaska State Troopers had asked her to provide to them. She said it was in Smith’s handwriting.
Wolfe asked if she knew Jackson Brauer, and she said she had known him for several years, and that he had once lived with her and Harold for “four or five months.”
“He was just a friend,” she said, adding that he and her husband worked and partied together.
Wolfe also wanted to know whether Mimi Enzler knew Dennis “Ray J” Johnson or Mark or Donna Wynkoop. She said she had met Johnson, but not the Wynkoops. She did stay at the Wynkoops’ house in mid-1994, however, while Smith was either renting the house or caretaking for it, she said.
The assistant D.A. showed Enzler a photo of the Wynkoops’ house near Sterling, Alaska, which she identified.
“When you stayed there, did anyone else stay there with you?” Wolfe asked.
“Once -- Sandy Hayes,” she replied.
“Did Mr. Smith know?” asked Wolfe.
“No,” she answered. “I wasn’t supposed to have anyone over. It was supposed to be a private place.”
Defense attorney Herz asked to approach the bench and once again, Judge Link instructed the court clerk to activate the courtroom white noise so only Herz, Link and Wolfe could hear what was about to be discussed.
While they talked, Billy Smith stared at Mimi. She looked away.
A moment later, Judge Link called for a 15-minute break.
